The Texas Behavioral Health Executive Council investigates and prosecutes professional misconduct committed by marriage and family therapists, professional counselors, psychologists, psychological associates, social workers, and licensed specialists in school psychology. Records for adults will be stored electronically for a minimum of 7 years. Minor client’s records will be stored electronically for 5 years past the date the child turns 18. Requests for records need to be made in writing and will take a minimum of 10 days to fulfill. In cases involving legal proceedings (e.g., divorce or custody cases), a court order may be necessary to release records, especially if the client has not provided explicit consent for disclosure.
